The Small Details (“TSD”)
Rental Agreement
This Rental Agreement is entered into between The Small Details (“TSD”) and the Customer listed on the quote or invoice.
1. Reservation & Payment
A 50% deposit is required to reserve rental items and remove them from inventory.
The remaining balance is due 7 days prior to delivery or pickup, unless otherwise agreed in writing.
If the balance is not paid on time, TSD may cancel the order and retain the deposit only to the extent of actual costs incurred (including preparation, labor, and inventory hold).
2. Rental Period & Responsibility
A standard rental period consists of three (3) consecutive calendar days, beginning on the delivery or pickup date.
All items must be returned by close of business on the third day. Items returned after this time may be charged an additional rental period, prorated or full, at TSD’s discretion.
“Close of business” means 5:00 PM local time, unless otherwise specified in writing.
Customer responsibility begins upon delivery or pickup and ends once items are returned and accepted by TSD.
3. Use & Care of Items
Customer agrees to use all rental items safely, properly, and only for their intended purpose.
TSD will provide items in clean, functional condition.
Customer is responsible for loss or damage beyond normal wear and tear while items are in their possession.
4. Damage, Loss & Inspection
TSD will inspect returned items within 72 hours and notify the Customer of any damage with reasonable documentation.
Customer is not responsible for:
Normal wear and tear
Pre-existing damage
Damage caused solely by defective items or improper installation by TSD
5. Routine Maintenance & Handling Fee
A 9% routine maintenance and handling fee is applied to all rental items to cover standard post-event processing, inspection, inventory handling, and routine upkeep associated with normal use.
This fee does not cover loss, theft, disappearance, misuse, or damage beyond normal wear and tear.
Broken items must be returned for the fee to apply.
6. Delivery & Pickup
Delivery includes a 2-hour arrival window, unless otherwise agreed.
Customer or a designated representative must be present to accept delivery.
Waiting time beyond 15 minutes may result in reasonable labor charges.
If Customer is unavailable, TSD may leave items in a reasonably safe location, at which point responsibility transfers to the Customer.
7. Weather & Unsafe Conditions
TSD may delay, modify, or suspend delivery due to unsafe site conditions or severe weather.
If delivery cannot occur, both parties will attempt to reschedule.
If cancellation is required, TSD may retain the deposit only to cover documented costs already incurred, with any unused portion refunded.
8. Cancellations & Changes
Cancellations more than 7 days prior to delivery:
The deposit may be applied as a one-time credit toward a future event within 6 months.Cancellations within 7 days of delivery:
The deposit is non-refundable due to scheduling, labor, and inventory commitments.Custom or specialty items are non-refundable once ordered or production has begun.
9. Customer Pickup
For customer pickup orders, Customer is responsible for safe transport and return of all rental items.
Any assistance provided by TSD staff with loading or unloading is a courtesy only. TSD is not responsible for damage to Customer vehicles during loading, unloading, or transportation of rental items.
All original packaging must be returned, or replacement fees may apply.
Customer agrees to provide a vehicle of sufficient size and capacity to safely transport their rental items.
10. Liability & Indemnification
Each party is responsible for its own negligence or misconduct.
Customer agrees to indemnify TSD for claims arising from Customer’s misuse or unsafe handling of rental items.
Nothing in this Agreement releases TSD from liability for defective equipment, improper installation, gross negligence, or willful misconduct, as prohibited under California law.
11. Venue Rules & Utilities
Customer is responsible for providing venue rules, access requirements, and identifying underground utilities.
Delays, fines, or damages caused by undisclosed site restrictions are the Customer’s responsibility.
12. Photo Use
TSD may use event photos for marketing unless Customer opts out in writing prior to the event.
13. Rental Charges
Prices are subject to change, however, the price listed when booking is confirmed and deposit paid will not be affected. If items are not returned on time, the pricing at the time of return will apply.
14. Governing Law & Disputes
This Agreement is governed by California law.
Any dispute shall be brought in Los Angeles County, California.
Attorney’s fees may be awarded to the prevailing party, as permitted by law.
Customer Acknowledgment
By signing or paying a deposit, Customer confirms that they have read, understood, and agree to these terms.
